Welcome to 90-Minute Trader™ (“Company”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, programs, digital products, and services (collectively, the “Services”). By purchasing, accessing, or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

1. Educational Purpose Only

All content provided through the Services, including training, programs, videos, guides, and materials, is for educational and informational purposes only. Nothing within the Services constitutes or should be relied upon as financial, investment, legal, or tax advice.

We are not licensed financial advisors, brokers, or investment firms. By using the Services, you acknowledge and agree that you are solely responsible for your own trading, investment, or financial decisions.

2. Eligibility

By accessing or purchasing our Services, you represent and warrant that you:

• Are at least 18 years of age (or the age of majority in your jurisdiction).

• Have the legal capacity to enter into binding contracts.

• Will use the Services for lawful purposes only and in accordance with these Terms.

3. Intellectual Property Rights

All content within the Services, including but not limited to text, videos, graphics, designs, software, logos, and trademarks, are the exclusive property of the Company or its licensors and are protected by copyright, trademark, and international intellectual property laws.

You are granted a personal, non-transferable, non-exclusive, revocable license to access and use the Services strictly for your personal, non-commercial use.

You agree not to:

• Copy, reproduce, modify, distribute, or create derivative works.

• Resell, sublicense, or otherwise exploit the Services.

• Share your login credentials or grant unauthorized access to others.

Violation of this clause may result in termination of your access and potential legal action.

4. Payments & Refunds

4.1 Payment Terms

You agree to provide current, complete, and accurate billing information for all purchases made through our Services. By submitting payment information, you authorize us (and our third-party payment processors) to charge the specified amount to your selected payment method. You are responsible for any fees, charges, or currency conversion costs imposed by your bank or payment provider.

4.2 Pricing & Taxes

All prices are listed in U.S. Dollars (USD) unless otherwise indicated. Prices may be subject to applicable taxes (including VAT for EU/UK customers), which will be calculated and displayed at checkout. You are responsible for any additional taxes, duties, or fees required by your jurisdiction.

4.3 Refund Policy

We believe in the effectiveness of the 90-Minute Trader™ program and stand behind its quality. To protect both our customers and our intellectual property, we offer a conditional 14-day refund policy, subject to the following terms:

1. Timeframe: Refund requests must be submitted within 14 calendar days of purchase by emailing [email protected]. Requests received after this period will not be eligible.
   

2. Proof of Participation: To qualify for a refund, you must demonstrate that you:

   • Have completed all the core lessons of the program,

   • Have attempted to apply the strategies taught, and

   • Provide a written explanation (minimum [X] words) of why the program did not work for you, including details of your attempts and challenges.
     

3. Exclusions: Refunds will not be granted for:

   • Failure to engage with the program or lack of effort,

   • Change of mind, lack of time, or personal preference (e.g., “it’s not for me”),

   • Technical issues on your side (e.g., internet access, device problems),

   • Accessing or downloading substantial portions of the content without completing the program.
     

4. Evaluation: Refund requests are reviewed on a case-by-case basis. Approval is at the sole discretion of the Company, provided the above conditions are fully met.
   

5. Waiver of EU/UK Right of Withdrawal: By purchasing and accessing the digital content immediately, EU/UK customers expressly agree to waive their statutory 14-day right of withdrawal for digital goods, in accordance with Article 16(m) of Directive 2011/83/EU and the UK Consumer Rights Act 2015.
   

6. Finality: Once a refund is issued, your license to access the program will be terminated, and you must delete any downloaded materials. After the 14-day period, or if the above conditions are not met, all sales are final and non-refundable.

5. User Obligations

You agree not to use the Services:

• For any unlawful purpose or in violation of applicable laws.

• To attempt to gain unauthorized access to our systems or interfere with their operation.

• To engage in harmful, abusive, defamatory, or fraudulent conduct.

We reserve the right to suspend or terminate your access if we believe you are violating these Terms or applicable law.

6. Earnings Disclaimer

We make no guarantees of earnings, profits, or trading success.

Any testimonials, case studies, or examples provided are extraordinary outcomes and do not represent typical or expected results.

Your results depend on multiple factors beyond our control, including your effort, discipline, knowledge, market conditions, and external risks. Past performance is not indicative of future results.

7. Third-Party Services

The Services may reference third-party proprietary trading firms, brokers, or platforms.

These third parties are independent and not controlled or endorsed by us.

We make no representation or warranty regarding their legitimacy, policies, or practices.

Your dealings with such third parties are solely between you and them.

8. Limitation of Liability

To the maximum extent permitted by law:

• We disclaim all liability for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Services.

• We are not responsible for any losses, claims, or damages resulting from your trading activities, reliance on our materials, or participation in third-party programs.

• Our total liability to you for any claim, whether in contract, tort, or otherwise, shall not exceed the amount paid by you for the Services.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your:

• Use of the Services;

• Violation of these Terms;

• Infringement of any third-party rights.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of:

• United States Customers: The State of Delaware, USA.

• UK & EU Customers: England and Wales, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the above jurisdictions, depending on your residence.

11. Consumer Rights (EU/UK Residents)

Nothing in these Terms affects your statutory consumer rights under applicable EU or UK law, including the Consumer Rights Act 2015 (UK) and Directive 2011/83/EU on Consumer Rights.

If you are an EU or UK consumer, you may have the right to withdraw from a distance contract within 14 days without giving reason, subject to the exceptions for digital content delivered immediately upon purchase (as outlined during checkout).

12. Modifications

We reserve the right to update, change, or replace these Terms at any time by posting the revised version on our website.

Continued use of the Services after such changes constitutes your acceptance of the updated Terms.
